PLEASE READ THIS TERMS AND CONDITIONS AGREEMENT ("AGREEMENT") CAREFULLY. THIS AGREEMENT IS A LEGAL CONTRACT BETWEEN YOU ("PURCHASER") AND LEVEL CONSTRUCTION AND DEVELOPMENT, LLC d/b/a LEVEL HOMES.  LEVEL HOMES IS A REGISTERED TRADE NAME OF LEVEL CONSTRUCTION AND DEVELOPMENT, LLC

By accessing or using any website with an authorized link to this Agreement, registering an account or accessing or using any content, information, services, features or resources available or enabled via any website relative to LEVEL CONSTRUCTION AND DEVELOPMENT, LLC d/b/a LEVEL HOMES (collectively with the Website, the "Services"), clicking on a button or taking another action to signify your acceptance of this Agreement, you: (1) agree to be bound by this Agreement and any future amendments and additions to this Agreement as published through the Services; (2) represent you are of legal age in your jurisdiction of residence to form a binding contract; and (3) represent that you have the authority to enter into this Agreement personally and, if applicable, on behalf of any company, organization or other legal entity on whose behalf you use the Services. Except as otherwise provided herein, if you do not agree to be bound by this Agreement, you may not access or use the Services.

Your use of the Services is also subject to any additional terms, conditions and policies that we separately post or publish ("Supplemental Terms") which are incorporated by reference into this Agreement. Purchaser ACKNOWLEDGES AND AGREES THAT THE WEBSITE AND ANY SITE-RELATED SERVICES ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR NONINFRINGEMENT OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 

Despite the best efforts of Level Homes to provide accurate information, including but not limited to prices and availability of homes or lots, it is not possible to completely ensure that information on this website is constantly correct. Level Homes does not warrant the accuracy and completeness of information, text, graphics, links or items contained on this website. All designs and/or images used are for illustrative purposes only, are intended to convey the concept and vision for homes, and are not intended to be complete in all respects and details.

Therefore, all maintenance tips, recommendations, videos and the like are not warrantied, not to be construed as an expansion of your warranty, and are provided as a courtesy for general information purposes only. Always refer and defer to manufacturers’ instructions and/or recommendations for all products and equipment.

This Agreement is entered into in the State of Louisiana and shall be governed by and construed in accordance with the laws of the State of Louisiana, exclusive of any choice of law statute. In the event that any of the provisions of this Agreement shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.

Disputes. Any disputes between the parties arising out of, or relating to, this Agreement or the breach thereof, or the construction shall, at the sole discretion of Seller, be mediated, which mediation, unless the parties mutually agree otherwise, shall be in accordance with the Construction Industry Mediation Rules of the American Arbitration Association currently in effect. The parties shall share the mediator’s fee and any filing fees equally. The mediation shall be held in the city and state where the Project is located, unless another location is mutually agreed upon. Agreements reached in mediation shall be enforceable as settlement agreements in any court having jurisdiction thereof.  

In the event that mediation is not attempted or not successful, Seller, in its sole discretion, may require that in the event that mediation is not successful, Contractor, in its sole discretion, may require that any disputes or claims be decided by arbitration in accordance with the construction industry arbitration rules of the American Arbitration Association currently in affect, unless the parties mutually agree otherwise. The award rendered by the arbitrators shall be final, and judgment may be entered upon it in accordance with applicable law in any court having jurisdiction thereof.
